Terms of Service
These terms define the service conditions between Dénéigement Quesnel (“the company”) and the client.
Using our services implies full acceptance of these terms.
1. Service Activation & Municipal Snowbank Removal
Operations begin when there are 5 cm or more of snow on the ground.
We commit to taking all reasonable measures to remove the municipal snowbank before 7:00 AM (depending on weather and City operations).
In cases of heavy accumulation, prolonged storms, or freezing rain, delays may be extended.
2. Final Cleaning (“Full Clearing”)
The final cleaning is performed after the snowfall has ended.
The client must remove all vehicles before 10:00 AM.
An automated text message is sent only when the team is heading out to perform the full clearing.
Overnight or preliminary passes do not require vehicles to be moved.
📌 Important
Text messages are not sent for preliminary passes.
They are sent only for the final pass, when the driveway will be fully cleared.
If vehicles are not removed:
The full clearing will be performed during the next precipitation.
3. Clear Access & Obstacles
The client must ensure that:
The snow removal area is clear at all times.
No object blocks access (garbage bins, recycling bins, decorations, wires, extensions, toys, furniture, etc.).
All obstacles are clearly identified.
Garbage Collection Days
On collection days:
➡️ The client must ensure that garbage and recycling bins do not block the snow removal area.
➡️ Any blocked driveway will be cleared only during the next precipitation.
4. Stakes & Signaling
We provide 2 stakes per client.
The client is responsible for keeping them in place and reporting any loss or damage immediately.
If the stakes are removed before our arrival, the company cannot guarantee:
a complete snow removal
the absence of damage
priority service
The client must mark at their own expense any particular obstacle (e.g.: stairs, lighting, bushes, electrical connections, decorative items, etc.).
5. Temporary Shelters (Tempo / Carport)
The client must notify us if there is a shelter.
The company is not responsible for any damage caused to a shelter that is:
unstable
weakened
poorly installed
too low for the machinery
or otherwise unsafe
6. Surface Types & Responsibility Limits
Different surface types react differently to winter operations:
Asphalt: existing cracks, sinking, fragile borders
Gravel: normal displacement of gravel
Pavers: seasonal movements, poorly installed blocks
Concrete: chipping or pre-existing wear
The company cannot be held responsible for damages caused by:
fragile or improperly installed surfaces
normal machinery use during snow removal
objects not visible under the snow
temporary car shelter anchors
blower or scraper marks
borders located within the first 4 feet from the street
unpaved or non-asphalted surfaces
natural conditions (freezing rain, ice, thaw, water accumulation, etc.)
any damage to garage doors when the driveway has a negative slope toward the door
7. Ice, Freezing Rain & Abrasives
The company cannot guarantee the absence of ice on the ground.
Inclined or icy driveways must be treated with abrasives by the client.
Without abrasives, service may be limited for safety reasons.
8. Snow Pile Placement
The client must designate a safe area on the property for snow piling.
The company does not transport snow off-site, unless a written agreement is made.
9. Service Calls
Any service call made outside regular operating hours may result in additional fees.
Any snow added manually or mechanically after the final pass will be considered a billable service call.
10. Payments & Fees
Any NSF cheque or declined credit card transaction will incur a $25 fee.
No refunds will be issued for periods already serviced.
11. Conduct Toward Personnel
No form of violence, threats, harassment, or intimidation — including via social media — will be tolerated.
➡️ The company reserves the right to terminate the contract without refund in such situations.
12. General Liability
The company is not responsible for damages caused to:
fences
hedges
walls
buildings
trees
decorative installations
objects left in the snow removal zone
items located near the snow piling area
13. Governing Law
These conditions are governed by the laws of the Province of Quebec.
In the event of a dispute, the courts of the local jurisdiction will apply.
